Republican-Led States Challenge Biden’s Keeping Families Together Program

Posted by Paul Saluja | Aug 26, 2024 | 0 Comments

In a move that has intensified the national debate on immigration, sixteen Republican-led states have filed a lawsuit against the Biden administration, challenging the recently launched "Keeping Families Together" program. This initiative, announced in June, offers a pathway to citizenship for nearly half a million immigrants who are married to U.S. citizens but currently lack legal status. The program, which began accepting applications on Monday, allows eligible spouses to apply for “parole in place,” providing temporary permission to stay in the U.S. and a subsequent opportunity to apply for a green card, eventually leading to citizenship.

The Legal Challenge: Politics vs. Policy

The lawsuit, filed in federal court in Tyler, Texas, argues that the Biden administration has overstepped its executive authority by creating a pathway to citizenship without Congressional approval. The states claim that the policy is a politically motivated attempt to secure votes in an election year, branding it as an act of “amnesty” that encourages illegal immigration and harms their economies.

Texas Attorney General Ken Paxton, a prominent figure in the lawsuit, stated that the program “violates the Constitution and actively worsens the illegal immigration disaster that is hurting Texas and our country.” Florida Attorney General Ashley Moody echoed this sentiment, accusing the administration of using “parole” systematically to advance an “open-borders agenda.”

The states also argue that the program imposes undue financial burdens, particularly in areas such as healthcare, law enforcement, and employment. According to the lawsuit, the influx of immigrants would strain public resources, increase crime rates, and depress wages for legal residents.

A Humanitarian Response or Executive Overreach?

The Biden administration and its supporters have defended the program as a necessary measure to protect families and uphold American values. DHS spokesperson Mayra Alejandra emphasized that the program is “grounded in well-established legal authority” and aligns with the fundamental American principle of keeping families together. White House spokesperson Angelo Fernández Hernández criticized the lawsuit as another attempt by Republicans to use immigration as a political weapon, accusing them of trying to “force U.S. citizens and their families... to continue to live in the shadows.”

Immigration advocates, including the bipartisan organization FWD.us and the Justice Action Center, have also condemned the lawsuit. They argue that the program is not only legal but morally imperative, as it provides a lifeline to mixed-status families who have long contributed to their communities.

The Broader Implications

The outcome of this lawsuit could have far-reaching implications for immigration policy in the United States. If the courts side with the Republican-led states, it could set a precedent that limits the executive branch's ability to use parole as a tool for immigration relief. On the other hand, if the program is upheld, it could pave the way for broader reforms that provide pathways to citizenship for millions of undocumented immigrants.

At Saluja Law, we recognize the complexities of immigration law and the profound impact these legal battles have on families and communities. The Keeping Families Together program, while controversial, represents a significant effort to address the longstanding challenges faced by mixed-status families. As this case unfolds, we will continue to monitor developments closely and provide updates on how the legal landscape evolves.

For now, it's important for those who may be eligible for the program to understand that the application process remains open. We encourage anyone with questions about their eligibility or the potential impact of the lawsuit to seek legal counsel. Our team is here to help navigate these uncertain times and advocate for the rights of immigrant families across the nation.
